Ancestroo Referral Program Terms and Conditions

1. Introduction; Scope; Eligibility.

Overview: These Referral Program Terms and Conditions ("Terms") govern Hey Now LLC dba "Ancestroo" ("Ancestroo," "we," "us," or "our"). Ancestroo's customer referral program ("Referral Program"), under which eligible Ancestroo Users ("User") may refer new customers to Ancestroo and, in return, both the referring user and the new customer each receive a one-time twenty percent (20%) discount on a qualifying Ancestroo purchase (each a "Referral Discount"). By participating in the Referral Program in any way or by using a Referral Discount, you agree to these Terms.

Relation to Terms of Service: These Terms supplement Ancestroo's Terms of Service ("ToS"). References to the term "Services" in the ToS are deemed to include participation in the Referral Program, as applicable. Capitalized terms not defined in these Terms have the meanings set forth in the ToS. If there is any conflict between these Terms and the ToS, the provisions of these Terms will control, but only with respect to your participation in the Referral Program.

Program Information: All material terms, conditions, and information about the Ancestroo Referral Program are contained in these Terms. Ancestroo may, at its discretion, publish supplemental details (such as instructions on how to participate, apply Referral Discounts, or track referral status) on its website at a later date. If such information is published, it will be for convenience only and may be updated at any time without notice. In the event of any conflict between these Terms and any content on Ancestroo's website, these Terms will govern.

Changes to Terms: Ancestroo reserves the right to make changes to these Terms at any time. Ancestroo will provide notice of such changes by updating the "Updated on" date above or by other reasonable means. Your continued participation in the Referral Program following any changes to these Terms constitutes your acceptance of the revised Terms.

Eligibility: The Referral Program is open only to Ancestroo users with an active account in good standing (for example, an active Ancestroo subscription or membership, if applicable), and who are located in the United States. The Referral Program is void outside of the United States and wherever else it may be prohibited by law.

2. Referral Discounts.

Nature of Referral Discount: A "Referral Discount" under this program represents a promotional discount (currently twenty percent off) applied toward the price of an eligible Ancestroo service or product purchase. Referral Discounts will be applied to reduce the cost of the applicable purchase at checkout. You may not sell, license, rent, transfer, or assign any Referral Discount. Referral Discounts have no intrinsic cash value, are not redeemable for cash, and are nonrefundable.

Forfeiture of Unused Discounts: Any Referral Discount that is earned but not used is subject to forfeiture and becomes void if: (i) your Ancestroo account is terminated for any reason; or (ii) Ancestroo determines that there has been fraud, abuse, or a violation of these Terms, the ToS, or any other applicable Ancestroo terms, policies, or laws by you or the referred party.

Reversal for Improper Use: Ancestroo reserves the right to charge your account or billing method for, or otherwise seek reimbursement of, the value of any Referral Discount obtained or used through fraudulent, illegal, or improper means, or in violation of the ToS, these Terms, or any applicable law or regulation. Ancestroo may rescind or adjust Referral Discounts if it finds they were obtained in error or violation of these Terms.

One Referrer per Referral: Only one Ancestroo user can qualify as the referrer ("referrer") for each new referred customer ("referee"). Each referral will result in a Referral Discount for a single referrer (and the corresponding referee) only. Disputes as to which User or other third party should receive a Referral Credit shall be resolved in Ancestroo's sole discretion.

Tracking and Technical Issues: Ancestroo is not responsible for any referral tracking issues or errors, whether due to the deletion or blocking of cookies, use of unauthorized referral links or codes, or other technical reasons. No Referral Discount will be granted if Ancestroo is unable to verify a referral's eligibility due to any technical malfunction, interference, or tracking failure.

Tax Matters: You are solely responsible for any tax obligations that may arise in connection with receiving or using Referral Discounts.

Ineligible Referrals: Referrals of any individuals for free or trial-based Ancestroo services (if any) are not eligible for Referral Discounts. In order for a referral to be eligible, the referred person must be a new customer to Ancestroo and must make a qualifying first purchase of an Ancestroo product or service. Referrals of any Ancestroo service that is offered for free (including trial or beta services, if applicable) will not result in any Referral Discount.

Accumulation ("Stacking") of Referral Discounts for Referrers: If you (as a referrer) refer multiple new customers, you may earn multiple Referral Discounts-one for each qualifying referred customer. However, Ancestroo does not allow these discounts to be combined or "stacked." Each Referral Discount must be redeemed individually and applied to a separate transaction. Referral Discounts cannot be used together on a single purchase, and unused discounts cannot be merged, transferred, rented, carried over, or applied retroactively.

Limit of One Discount per New Customer: Each new referred customer may use only one referral code or Referral Discount for their first purchase with Ancestroo. In other words, a referral code cannot be used for a second or additional purchase of an Ancestroo Story.

3. Promotional Methods and Restrictions.

Responsible Promotion: The Referrer is responsible for any content and communications they use to promote Ancestroo in connection with the Referral Program ("Promotional Content"). Any Promotional Content you distribute should truthfully and accurately represent Ancestroo's services. You may include authorized versions of Ancestroo's name, logos, or trademarks in your Promotional Content, but only in accordance with Ancestroo's guidelines and with Ancestroo's prior authorization where required.

Compliance with Modification Requests: The Customer shall promptly comply with any instruction from Ancestroo to modify or remove any Promotional Content. Ancestroo reserves the right to request changes or removal of content that misrepresents Ancestroo or violates any of the restrictions in these Terms.

Legal Compliance (FTC and Other Laws): Promotional Content must comply with all applicable laws and regulations, including the Federal Trade Commission (FTC) endorsement rules governing testimonials and endorsements. This means, for example, you must clearly disclose in your Promotional Content that you may receive a benefit (a Referral Discount) if someone uses your referral link or code. All marketing and referrals must be done in a legal, ethical manner consistent with relevant advertising standards and Ancestroo's policies.

4. Exclusive Remedy.

Without limiting any other provision of these Terms or the ToS, Customer's sole and exclusive remedy for any claims or disputes arising out of or relating to the Referral Program (including Ancestroo's failure to provide any Referral Discount or any other issue) shall be limited to the potential issuance or re-issuance of the applicable Referral Discount to the Customer, if earned in accordance with these Terms. In no event shall Ancestroo be liable for any direct, indirect, incidental, special, or consequential damages or losses of any kind arising from or in connection with the Referral Program, beyond the explicit provision of the Referral Discount as described. (All other legal limitations of liability stated in the ToS apply to this Referral Program as well.)
